Subject: 20853/Annex/Summit/AdoptPOS Date: Fri, 19 Aug 1994 15:08:20 -0500 RESOLUTION NO. 20853 A RESOLUTION ADOPTING A PLAN OF SERVICES FOR THE ANNEXATION OF CERTAIN PROPERTIES ADJACENT TO SUMMIT LANDFILL, MORE SPECIFICALLY DESCRIBED HEREIN, LYING CONTIGUOUS TO THE PRESENT CORPORATE LIMITS OF THE CITY OF CHATTANOOGA, TENNESSEE. _________________________ WHEREAS, Tennessee Code Annotated Section 6-51-102, as amended, requires that a plan of services be adopted by the governing body of a city prior to passage of an annexation ordinance if any territory or territories totaling more than one-fourth square mile (160 acres) or having a population of more than 500 persons may be annexed within any 12-month period; and WHEREAS, the City of Chattanooga may have exceeded one (or both) of these minimum conditions by the proposed annexation of an area bounded as follows: BEGINNING at a point in the existing Chattanooga City Limit line, said point being approximately 500 feet east of the Pattentown Road east right-of-way line extended and the north right-of-way line of Apison Pike, said right-of way line being 25 feet north of the Apison Pike center line; thence, along the north right-of way line of Apison Pike in a northeasterly direction, 25 feet north of and parallel to its center line, a distance of approximately 2,625 feet, to a point which is opposite the northwestern property corner of Parcel 160.04, Hunnicutt Tax Map 140; thence, at right angles in a southerly direction, a distance of 50 feet, to said northwestern property corner; thence, along the western property line of said Parcel 160.04 and the east right-of-way line of an unnamed road, to the 0C southwestern property corner of said parcel, a distance of approximately 200 feet, to a point of curvature to the left; thence, in an easterly direction, along the radius line of said curve, a distance of approximately 10 feet, to a point which is 30 feet east of the center line of said unnamed road; thence, curving to the left, 30 feet east of and parallel to its center line which has a radius of 680 feet, a delta of 21B023'06", and a length of 253.8 feet, to its point of tangency; thence, along said tangent in a southeasterly direction a distance of approximately 129 feet, to a point of curvature to the right; thence, 30 feet east of and parallel to the center line which has a radius of 1,100 feet, a delta of 19B024'09", and a length of 372.5 feet, to a point of tangency; thence, along said tangent in a southeasterly direction a distance of approximately 106 feet, to a point of curvature to the left; thence, 30 feet east of and parallel to the center line which has a radius of 200 feet, a delta of 12B004'03", and a length of 42.1 feet, to a point of curvature to the right; thence, 30 feet east of and parallel to the center line which has a radius of 200 feet, a delta of 9B053'23", and a length of 34.5 feet, to a point of tangency; thence, along said tangent in a southeasterly direction a distance of approximately 168 feet, to a point of curvature to the left; thence, 30 feet east of and parallel to the center line which has a radius of 340 feet, a delta of 42B036'24", and a length of 252.8 feet, to a point of tangency, thence, along said tangent in a southeasterly direction, a distance of approximately 100 feet, to a point of curvature to the right; thence, 30 feet east of and parallel to the center line which has a radius of 160 feet, a delta of 26B001'48", and a length of 72.7 feet, to a point of tangency; thence, along said tangent in a southeasterly direction, a distance of approximately 100 feet, to a point in the north line of Parcel 160.05, Map 140, and the existing Chattanooga City Limit line; thence, following the existing city limit line in a northwesterly direction, a distance of approximately 75 feet, to point in the western right-of-way line of the 60 foot unnamed road; thence, following said right-of-way line in a northwesterly direction, a distance of approximately 50 feet, to a point of curvature to the left; thence, 30 feet west of and parallel to the center line which has a radius of 160 feet, a delta of 26B001'48", and a length of 72.7 feet, to a point of tangency; thence, along said tangent in a northwesterly direction, a distance of approximately 100 feet, to a point of curvature to the right; thence, 30 feet west of and parallel to the center line which has a radius of 340 feet, a delta of 42B038'24", and a length of 252.8 feet, to a point of tangency; thence, along said tangent in a northwesterly direction, a distance of approximately 168 feet, to a point of curvature to the left; thence, along said tangent in a northwesterly direction, a distance of approximately 106 feet, to a point of curvature to the left; thence, 30 feet east of and parallel to the center line which has a radius of 1,100 feet, a delta of 19B024'09", and a length of 372.5 feet, to a point of tangency; thence, along said tangent in a northwesterly direction, a distance of approximately 129 feet, to a point of curvature to the right; thence, 30 feet west of and parallel to the center line which has a radius of 680 feet, a delta of 21B023'06", and a length of 253.8 feet, to the southeastern property corner of Parcel 160.03, Map 140; thence, along the eastern property line of said parcel in a northeasterly direction, to a point which is 25 feet south of the center line of Apison Pike; thence, 25 feet from and parallel to the center line of Apison Pike, a distance of approximately 2,575 feet, to a point which is approximately 500 feet east of the eastern right-of-way line of Pattentown Road, being also in the existing Chattanooga City Limit line; thence, following the existing city limit line in a northerly direction, crossing the Apison Pike right-of-way, to the POINT OF BEGINNING. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE: Section 1. Pursuant to the provisions of T.C.A. A76-51-102, there is hereby adopted, for the area bounded as described above, the following plan of services: The City Council of the City of Chattanooga, Tennessee hereby proposes the following Plan for Provision of Services for an annexation area of certain properties adjacent to Summit Landfill, lying contiguous to the present corporate limits of the City of Chattanooga, Tennessee as set forth within the attached Resolution. A. POLICE Patrolling, radio directed response to calls for assistance, crime prevention services, traffic control and accident prevention services and other police protection and support using present personnel and equipment will be provided on the effective date of annexation. B. TRAFFIC ENGINEERING Traffic engineering and installation of signs and other traffic control devices to be installed as required throughout the annexation area, when the need is established by appropriate traffic studies. C. FIRE 1. Fire protection by present personnel and the equipment of the fire fighting force within the limitations of available water and distance from fire stations will be provided on the effective date of annexation. 2. Additional fire services such as those made available through the City's fire prevention bureau and its arson investigation unit will be made available on the effective date of annexation. 3. Within six (6) months after annexation, fire hydrants will be installed in those areas where water mains of adequate size are available. Placement of hydrants will be on the basis of nationally-accepted standards defined by the National Fire Underwriters' Association. As additional water lines are extended into areas that are not presently served, fire hydrants shall be installed as required by the above-mentioned standards. 4. Within six (6) months after annexation a study will be completed to determine the need for the establishment of a fire substation in or near the annexed area to assure the continued compliance with standards established by the National Fire Underwriters' Association appropriate to the existing fire insurance rating. D. REFUSE COLLECTION The same regular refuse collection now provided by the City will be extended to the annexed area on the effective date of annexation. E. STREETS 1. Emergency maintenance of streets (repair of hazardous chuck holes, measures necessary to maintain normal traffic flow), removal of snow and/or sanding of streets during icing conditions will begin on the effective date of annexation. 2. Routine maintenance, on the same basis as in the present City, will begin in the annexed area following the effective date of annexation. 3. Within six months of annexation, street name signs will be installed as needed in all substantially developed areas. 4. Street lights will be installed under the same standards as now prevail in the City. 0C F. PLANNING AND ZONING The planning and zoning jurisdiction of the City will extend to the annexed area on the effective date of annexation. City planning will thereafter encompass the annexed area. Pending a review of the zoning by the Chattanooga-Hamilton County Planning Commission and the City, the property shall be re-classified to a temporary classification pursuant to Article X, Section 100 of the City's Zoning Ordinance. G. RECREATION FACILITIES 1. All of the recreational areas and programs provided for the present City residents will be made available immediately to the residents of the annexed area. 2. Summer recreation programs such as softball tournaments and Little League will be made available to all residents. H. WATER SYSTEM Water for domestic, commercial and industrial uses will continue to be provided to residents of the newly annexed area by the Eastside Utility District. I. ELECTRICAL SERVICE Electricity for domestic, commercial and industrial uses will continue to be provided to residents of the newly annexed area by the Electric Power Board of Chattanooga. J. SEWER SYSTEM The existing Moccasin Bend Wastewater Treatment Plant is adequately sized to treat the flow from its Chattanooga service area. Interceptor sewers have been constructed nearby to transmit flow within the existing City boundaries. Sewers will be extended into the annexed area in accordance with the overall sewage development plan. K. INSPECTION/CODE ENFORCEMENT Chattanooga now provides inspection and code enforcement services (building, electrical, plumbing, gas and better housing) to all areas of the City. These same services will be provided to the newly annexed area when it becomes a part of the municipality. L. ANIMAL CONTROL The Humane Educational Society of Chattanooga provides the services of animal control and enforces the City's leash laws and other animal control ordinances.
